No parece aventurado pro-nosticar que una eventual reforma de la Constitución abrirá de nuevo el tema de sus efectos sobre las leyes en vigor que la contradigan, así como sobre la función del Tribunal Constitucional y los jueces ordi-narios en la aplicación de tales efectos. En este trabajo se sostiene que la alternativa por un modelo concentrado o difuso de control no debe reposar en los conceptos de inconstitucionalidad sobrevenida y de-rogación, sino en las razones materiales que justifican uno u otro modelo como su incidencia en la seguridad jurídica, en la posición del legislador democrático, en la resolución de los litigios en un plazo razo-nable, en los derechos fundamentales en cada caso afectados, etc. An eventual reform of the Con-stitution will reopen the issue of its effects on existing laws that contradict it, as well as on the role of the Constitutional Court and ordinary judges in the implementation of such effects. ... This paper argues that the alternative for a concentrated or diffuse model of control should not be based on the concepts of unconstitutionality and abrogation, but rather on the material rea-sons that justify one or the other model, such as its impact on legal certainty, on the position of the democratic legislator, on the resolution of disputes within a reasonable period of time, on the fundamental rights in each case affected, etc. |
