Del lado de los caníbales. Etnografía jurídica y esclavitud india

Abstract

El «indio» fue instituido por los españoles en el mismo momento en que tomaron posesión de él, asignándole el papel que consideraban que le corres-pondiese en el orden natural de las cosas. En principio, él fue siervo por naturaleza porque era «bueno» hasta el punto de resultar vil e inepto; luego, fue esclavo por ley porque se negó a asumir ese papel. Se ha afirmado —no sin razón— que el «caníbal rebelde» no fue más que una invención gracias a la cual fue posible esclavizar los «indios» sin tener que esperar que se rebe-laran de verdad; sin embargo, sería errado creer que tal invención no haya tenido nada que ver con la resistencia que fue efectivamente opuesta frente a cualquier intento de sujetarlos.

The «indio» was instituted by the Spaniards as soon as they took pos-session of hím, ascribing to him the role that they thought fit for him in the natural order of things. In the beginning, he was a slave by nature because he was «good» to the point of appearing vile and inept, and eventually he was a slave by the law because he refused to assume that role. It has been argued, sometimes rightly so, that the «rebellious cannibal» was only an invention through which it was possible to enslave the «indio» without having to wait for their actual rebellion. Yet it would be wrong to believe that such an invention had nothing to do with the resistance that was actually opposed, by some of them, to their subjugation and submission.
