Article 9 of the Multilateral Ibero-American Social Security Agreement addresses the issue of the law applicable in particular, the general rule. Thus it is established that the persons to whom this Agreement applies shall be subject exclusively to the social security legislation of the State in whose territory engaged in an activity. This text opts for the lex loci laboris as a general rule to establish which is the legislation applicable to workers covered by the scope of the Multilateral Ibero-American Social Security Agreement regardless of their nationality or place of residence and is a manifestation of the principle of a single national law applicable. This is a typical rule of coordination of Social Security Systems that would enhance the legal certainty intended to resolve any doubts about the applicable law and is present in other agreements or bilateral or multilateral agreements on social security. |
