afirmación cultural frente al colonialismo ... Tras su independencia, los nuevos Estados árabes reconocieron en sus constituciones el papel del Islam como religión oficial del Estado. Este hecho, a la vez que implicaba una afirmación cultural frente al colonialismo europeo, otorgaba valor normativo a las disposiciones contenidas en las fuentes sagradas del Islam que determinan un estatuto jurídico diferenciado en función del género. Al mismo tiempo, estas constituciones reconocerán el principio de igualdad jurídica sin discriminación por causa de género. Esta dicotomía en los ordenamientos jurídicos de los países árabes se ha manifestado durante los últimos años en dos tendencias claras. Por una parte, se ha tratado de presentar una postura común que compatibilice los preceptos de la Ley Islámica con el principio de igualdad de género, en instrumentos tales como la Declaración Islámica de los Derechos del Hombre, o en las reservas formuladas en la ratificación de instrumentos de Naciones Unidas. Por otra parte, la progresiva incorporación de la mujer al ámbito universitario y laboral, así como la creciente cooperación política con la Unión Europea esta impulsando en numerosos países árabes nuevas medidas legislativas que tienden a suprimir las discriminaciones existentes en materia de Derechos Políticos, Derecho Penal, Estatuto Personal o de Nacionalidad. |
