Abstract | La presente tesis doctoral tiene por objeto el análisis de la Directiva 2014/41/CE, del Parlamento Europeo y del Consejo, de 3 de abril, y su transposición al ordenamiento jurídico español, a través de la Ley 3/2018, de ... La presente tesis doctoral tiene por objeto el análisis de la Directiva 2014/41/CE, del Parlamento Europeo y del Consejo, de 3 de abril, y su transposición al ordenamiento jurídico español, a través de la Ley 3/2018, de 11 de junio, por la que se modifica la Ley de reconocimiento mutuo de resoluciones penales en la Unión Europea, para regular la Orden Europea de Investigación. Este instrumento de reconocimiento mutuo supone un cambio importante en la obtención de la prueba transfronteriza. Nos centramos en el estudio del ámbito y contenido de la orden europea de investigación, así como en la fase de emisión y de ejecución. Especial atención prestamos al papel de las autoridades competentes, en particular al que asume el Ministerio Fiscal español en la fase de reconocimiento y ejecución de una orden. Del mismo modo, estudiamos las posibilidades de sustitución de una medida de investigación, así como la suspensión de la ejecución de la orden. También examinamos las causas de denegación y su incidencia en el principio de reconocimiento mutuo. Y por último, destacamos la importancia del sistema de recursos previsto en la Directiva y las distintas posibilidades en el Estado de emisión y de ejecución. O objetivo desta tese de doutoramento é analisar a Diretiva 2014/41/UE, do Parlamento Europeu e do Conselho, de 3 de abril, e a sua transposição para o ordenamento jurídico espanhol, através da Lei n.º 3/2018, de 11 de junho, que altera a Lei do reconhecimento mútuo das decisões penais na União Europeia, para regulamentar a decisão europeia de investigação. Este instrumento de reconhecimento mútuo representa uma mudança importante na obtenção de provas transfronteiriças. Centramo-nos no estudo do âmbito de aplicação e conteúdo da Decisão Europeia de Investigação, bem como na fase de emissão e execução. Prestamos especial atenção ao papel das autoridades competentes, em particular do Ministério Público espanhol na fase de reconhecimento e execução de uma decisão. Estudamos igualmente a possibilidade de substituição de uma medida de investigação, bem como a suspensão da execução de decisão. Examinamos também os motivos de recusa e o seu impacto no princípio do reconhecimento mútuo. Por fim, destacamos a importância do sistema de recursos previsto na diretiva e as diferentes possibilidades no Estado de emissão e de execução. |
