Derechos y también deberes. El caso de la donación de sangre

Abstract

La legislación española prohíbe remunerar la donación de sangre. No obstante, el Estado permite la importación de derivados de la sangre, aun proveniente de donantes remunerados, para satisfacer las necesidades del país. En esta comunicación defenderemos que el establecimiento de un deber cívico de donar sangre sería, paradójicamente, más coherente con la legislación en la materia que la situación actual. Para ello, nos basaremos en la teoría según la cual, para que alguien disfrute de un derecho otro deberá cumplir una obligación; en nuestro caso, la obligación de donar sangre permitirá garantizar el derecho a recibir un tratamiento hemoterápico sin colisionar con la letra de la legislación y los principios que la inspiran

Blood donation is banned by the Spanish regulation. However, the State permits the importation of blood products, even if they come from paid donors, in order to meet our nation’s requirements. In the present paper we will defend that the enactment of a civic duty to donate blood would be, paradoxically, more consistent with the national legislation regarding the aforementioned subject that the current situation. With such an aim, we will take as a basis the theory according to which, in order for an individual to benefit from a right, another one must fulfill a duty; in our case, the duty to donate blood would allow for warranting the right to receive a blood-based treatment without colliding with the letter of the law and its underlying principles
