En particular, el concepto de libertad, ... Los principios generales del Derecho Constitucional Romano han ejercido una profunda y continua influencia real en el desarrollo de las instituciones político-constitucionales europeas. En particular, el concepto de libertad, libertas, entendido como ámbito protegido y limitado de ejercicio de los derechos del ciudadano y como posibilidad de participación en las decisiones de la res publica, organización del populus, conforma una de las piezas básicas de la forma mentis del constitucional europeo. Las modernas democracias occidentales se hallan enraizadas en este universo de ideas y prácticas vinculadas históricamente al pasado romano. Un conjunto de razones ideológicas explica la negación de esta identidad y de su desplazamiento hacia un modelo no real sino reconstruido como es el modelo griego. Es necesario, por tanto, una indagación sobre los orígenes romanos de la democracia. |
