Campo material de aplicación del Convenio Multilateral Iberoamericano de Seguridad Social: un paso a la vez

Abstract

La región de América Latina posee un nivel de migración interna muy elevado, incluso superior al europeo. Debido a esto, diversos mecanismos de coordinación se han intentado históricamente. De entre estos el más reciente lo constituye el Convenio Multilateral Iberoamericano de Seguridad Social (CMISS). Este instrumento internacional sigue de muy cerca la técnica jurídica de la regulación europea en materia de coordinación. Este trabajo realiza un breve comentario al campo materia de aplicación del CMISS, el cual en un principio sigue los lineamientos europeos pero a la vez establece normas distintas. De esta manera se intentará resaltar las particularidades de la región latinoamericana frente a las necesidades de protección de los migrantes. Se concluye con algunas reflexiones hacia donde debe ir avanzando la coordinación en la región latinoamericana, la cual se considera buena pero falta avanzar mucho más.

The Latin American region has a very high level of internal migration, even higher than the European one. Because of this various coordination mechanisms have been tried historically. Of these the most recent constitutes the Ibero-American Multilateral Convention on Social Security (CMISS). This international instrument is closely monitoring the legal technique of European regulations on coordination. This paper provides a brief commentary on the scope of CMISS, which initially follows the European guidelines but also establishes different rules. In this way we will attempt to highlight the peculiarities of the Latin American region regarding the need for protection of migrants. We conclude with some considerations as to where coordination should go forward in the Latin American region, where it is considered good, but there still a long way to go
