Naturaleza y eficacia de los documentos de instrucciones previas

Abstract

La Ley 41/2002 ha recogido como principios básicos, tres derechos que consagran jurídicamente la autonomía del paciente: primero, toda actuación sanitaria ha de ir precedida del correspondiente consentimiento informado (art. 2.2); segundo, el paciente tiene derecho a elegir entre varias alternativas terapéuticas (art. 2.3); tercero, el paciente tiene derecho a rechazar tratamientos médicos (art. 2.4). Además, todo profesional sanitario está obligado a respetar las decisiones adoptadas libre y voluntariamente por el paciente (art. 2.6), las cuales se contienen no sólo en los documentos de consentimiento informado, sino también en los documentos de instrucciones previas, que recogen verdaderas declaraciones de voluntad, con la eficacia jurídica que nuestro Derecho reconoce a la autonomía privada. La voluntad del paciente es soberana en relación con su salud e integridad física, con los límites que la propia Ley señala en el art. 9 para el consentimiento informado, y en el art. 11.3 para los documentos de voluntades anticipadas

Spanish Act 41/2002 has as basic principles, three rights that legally establish the autonomy of the patient: first, every health action must be preceded by the corresponding informed consent (article 2.2); Second, the patient has the right to choose between several therapeutic alternatives (article 2.3); Third, the patient has the right to refuse medical treatment (Article 2.4). In addition, every healthcare professional ist obliged to respect the decisions freely and voluntarily taken by the patient (Article 2.6), which are contained not only in the informed consent documents, but also in the previous instructions documents, which contain true statements of will, with the legal effectiveness that our law recognizes to the private autonomy. The patient's will is sovereign in relation to his health and physical integrity, with the limits that the Law itself states in art. 9 (Act 41/2002) for informed consent, and in art. 11.3 for advance directive documents
