Ciencia del derecho en la escuela histórica y la jurisprudencia de conceptos

Abstract

En los comienzos del siglo XIX la Ciencia del Derecho renace en el país germánico: se vuelve sobre las fuentes para trabajarlas de manera nueva y actualizada, según modelos que perdurarán hasta nuestros días (Pandectística); se desarrollan corrientes intelectuales que abordan el fenómeno jurídico desde nuevas posturas filosóficas, según las necesidades sociales imperantes en el momento (Jurisprudencia de Conceptos/ Jurisprudencia de Intereses). Esta atmósfera de cambios propició un debate intelectual en torno al fenómeno jurídico y al concepto de Justicia que aún hoy, dos siglos más tarde, persiste en términos muy similares. Por lo demás, nuestro actual Derecho es un Derecho en crisis, y el estudio de su pasado puede aportar algo de luz para afrontar su futuro

This paper provides some light into the complex study of the history of Jurisprudence and Philosophy of Law in the german nineteenth century. During this rich period the Science of Law revives: it turns on to the sources to work them in a new and updated way, according to models that endure to this day (Pandectism); Intellectual movements that address the legal phenomenon from new philosophical positions emerge, according to the prevailing needs of the moment (Jurisprudence of Concepts / Jurisprudence of Interests). This change led to an atmosphere of intellectual debate on the legal phenomenon and the concept of Justice that even today, two centuries later, remains in very similar terms. Otherwise, our current law is in difficulty, and the study of its past can bring some light to face its future.
