Tras una introducción basada en la necesidad de aunar la ciencia biomédica y la regulación jurídica de la misma, se analizan los antecedentes de las normas vigentes españolas respecto a donación y trasplante de órganos, realizando un paralelismo en Derecho comparado entre las regulaciones latinoamericanas y las europeas.
