La audiencia del menor en los procesos de divorcio nacionales e internacionales. Comentario a la STS (Sala Primera) de 30 junio

Abstract

En los procesos judiciales donde se adopten medidas de protección que afectan a menores de edad. residan en nuestro país o en el extranjero. se impone al juez o tribunal que conoce del asunto, tanto en la normativa nacional como internacional, velar porque se cumpla y garantice el derecho de los menores a ser oídos. para que esas medidas de protección sean en su interés. Se establece, en la vigente normativa procesal, que esa audición no es obligatoria, sino que sólo se realizará cuando sea necesaria. Siendo el Juez, las partes. el Ministerio Fiscal, o el propio menor, los que pueden invocar y acreditar esa necesidad, y provocar la audición del menor. En el asunto de la sentencia del Tribunal Supremo se confirma esta necesidad de audiencia de la menor. porque tiene la edad y la madurez adecuada. que ha sido cumplida por el Juzgado de Primera Instancia. estableciendo un derecho de visita a favor del padre de manera flexible (por residir la hija en el extranjero) y que la Audiencia concreta, sin necesidad de tener, de nuevo que ser oída la menor. Por tanto, se ha respetado esa manifestación del principio fundamental del interés del menor.
