Abstract

El análisis que esté realizando el Sistema Europeo de Derechos Humanos en relación al discurso de odio online resulta de gran relevancia para hacer frente a uno de los mayores conflictos jurídico-sociales del siglo XXI. La proliferación de expresiones de odio en Internet desafía el ejercicio del derecho a la libertad de expresión. Es esencial comprender cómo se aborda esta problemática a nivel regional, con el objetivo de lograr una persecución efectiva y armonizada entre todos los Estados Miembros del Consejo de Europa. Esta tarea implica explorar las tensiones entre la protección de la libertad de expresión y la necesidad de salvaguardar la dignidad humana y los derechos fundamentales. En última instancia, comprender cómo el Sistema Europeo de Derechos Humanos aborda el discurso de odio online es fundamental para promover sociedades inclusivas, respetuosas y democráticas en la era digital en nuestro continente.

The analysis being carried out by the European Human Rights System in relation to online hate speech is of great relevance in addressing one of the greatest social-legal conflicts of the 21st century. The proliferation of hate speech on the Internet challenges the exercise of the right to freedom of expression. It is essential to understand how this issue is addressed at the regional level, with the aim of achieving effective and harmonised prosecution among all Council of Europe member states. This task involves exploring the tensions between the protection of freedom of expression and the need to safeguard human dignity and fundamental rights. Ultimately, understanding how the European Human Rights System addresses online hate speech is fundamental to promoting inclusive, respectful and democratic societies in the digital age on our continent.
