Los depósitos bancarios de titularidad plural, especialmente cuando se pacta la disposición de los fondos de forma indistinta, constituyen uno de los supuestos que ha originado mayor conflictividad en la práctica bancaria de nuestro país. La declaración de concurso de un titular de un depósito indistinto hace necesario determinar cuál es la posible cuota de participación del titular concursado sobre el crédito a la restitución de las sumas depositadas que los cotitulares ostentan frente a la entidad, a los efectos de su inclusión en la masa activa del concurso. El art. 197 del Texto Refundido de la Ley Concursal (TRLC), conforme a la nueva redacción dada por la Ley 16/2022, de 5 de septiembre, de reforma del Texto Refundido de la Ley Concursal, regula esta cuestión y establece una presunción de propiedad de los fondos depositados a favor del concursado y ordena a la administración concursal la integración de la totalidad del saldo que arroje la cuenta en la masa activa del concurso. El objeto de este trabajo es analizar en detalle el contenido del art. 197 TRLC estudiando tanto los presupuestos para su aplicación como cada una de las consecuencias previstas por la norma. The declaration of insolvency of a holder of an indistinct deposit makes it necessary to determine what is the possible share of the insolvency holder on the credit for the restitution of the sums deposited that the co-holders hold before the entity, for the purposes of their inclusion in the active mass of the contest. The art. 197 of the Consolidated Text of the Insolvency Law (TRLC), in accordance with the new wording given by Law 16/2022, of September 5, reforming the Consolidated Text of the Insolvency Law, regulates this issue and establishes a presumption of ownership of the funds deposited in favor of the insolvent and orders the insolvency administration to integrate the entire balance of the account into the active mass of the insolvency. The purpose of this paper is to analyze in detail the content of art. 197 TRLC studying both the budgets for its application and each of the consequences provided by the norm. |
