El ius repraesentationis es figura ideada por el Derecho romano para atender a los intereses de los descendientes del hijo que premuere a su padre, cuando a la muerte de este concurren a su sucesión intestada con otros parientes de grado más próximo al causante, y por tanto en principio con mejor derecho a su herencia. Pero en los últimos tiempos ha extendido su operatividad a otros supuestos: hijo que no puede heredar por causa de indignidad o desheredación, pero que tiene descendientes que también lo son por tanto del causante, aunque de grado más lejano. Y esto no solo en el ámbito de la sucesión intestada, que era el tradicional, sino también en el de la sucesión testada. Queda todavía, sin embargo, un último supuesto por alcanzar: el caso en que el sujeto inicialmente llamado a una herencia la repudia, teniendo descendientes que también lo son del causante aunque más lejanos, cuando a esa herencia concurren también otros parientes más cercanos. Este trabajo se centra en este supuesto. A resultas del cual se muestra que el derecho de representación es aplicable también a este caso de lege lata en nuestro Derecho actual, se señalan los requisitos para que proceda, y se precisa la medida del mismo. The ius repraesentationis is a figure designed by Roman law to attend the interests of the son ́s descendents in case he dies before his father, when at the death of this one those descendents stand with relatives who have a closer degree of kinship with the deceased, and therefore in principle a better right to his intestated succession. Nevertheless, this figure has in recent times spread its operational capacity to other cases: son who cannot inherit becau-se of dishonesty, or of disinheritance, but that has descendants that are also descendants of the deceased, although in a more distant degree. And this extension of the figure is not regarded exclusively in the area of intestated succession –which was the traditional one–, but also in testated succession. There remains, however, another case to consider, which is the purpose of the present essay: that in which the one initially called to an inheritance repu-diates it, having descendants that are also descendants of the deceased but in a more distant degree, and that stand with relatives with a closer degree with the decesased. This essay focuses on this hypothesis. As a result of it, it is shown that this right is also applicable in this case de lege lata in our current law, the requirements for it are identified, and it is settled its measure. |
