Abordando el legislar sobre cuestiones agrícolas y alimentarias

Abstract

A partir de esbozar la manera como en el derecho internacional, presente y pasado se articularon las necesidades sociales, su satisfacción, los recursos materiales sobre los que éstas se realizaron y las formas de propiedad de la tierra, se analizó la triada tierra, seguridad alimentaria y propiedad. La revisión bibliográfica y documental que soportó el documento hiso énfasis en los materiales generados en el marco de las organizaciones internaciones al tenor de Naciones Unidas, particularmente la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO). Se concluye que es posible y pertinente imaginar normas jurídicas que a la par de recuperar la especificidad de las cosas recuperen la prioridad de las necesidades sociales, en primer lugar, el derecho a la alimentación, cuestión que reformula el papel de la tierra;la clave está en la afirmación de que los recursos vitales no son mercancías como cualquier otra. El hecho de que un bien sea apropiado no impide que se considere “destinado” y que un cierto número de personas se beneficien de él en virtud de este propósito común o colectivo. El problema no es la propiedad, sino la propiedad exclusiva.

Based on an outline of the ways in which present and past social needs, their satisfaction, the material resources by which they were realized, and forms of land ownership have been articulated in international law, we analyzed the triad of land, food security and property. The bibliographic and documentary review that supported the document emphasized the materials generated within the framework of international organizations under the United Nations, particularly the Food and Agriculture Organization (FAO). It is concluded that it is possible and relevant to imagine legal norms that, while recovering the specificity of things, recover the priority of social needs, the first of which is the right to food, an issue that reformulates the role of land. The key lies in the assertion that vital resources are not commodities like any other. The fact that goods are appropriated does not prevent them from being considered “destined” and from a certain number of people benefiting from them by virtue of this common or collective purpose. The problem is not ownership, but exclusive ownership.
