Lawfare y sus ideas fuerza en el discurso político de Unidas Podemos (UP)

Abstract

El presente trabajo estudia el lawfare, un preocupante fenómeno, que viene desarrollándose durante las últimas dos décadas en perjuicio de los sistemas democráticos occidentales. Esta emergente estrategia ha instrumentalizado el derecho y la justicia y los ha dispuesto al servicio de un entramado en el que se combinan los poderes políticos, económicos y mediáticos, empleando como arma ilegítimamente el poder judicial. Su objetivo es el mismo que el que tenían los ya otrora golpes de Estado militares: destruir al adversario político. Esta investigación, por lo tanto, pretende examinar, dada su relevancia actual, el lawfare como fenómeno integral y multicausal, analizando someramente cómo opera, qué recorrido histórico ha transitado, qué dispositivos comporta, qué peligros entraña y especialmente, cuáles son los motivos que han suscitado que el poder judicial, los jueces y los medios judiciales sean parte indispensable de esta guerra desde y en los tribunales, entre ellos, el poder omnímodo que detentan hoy día los jueces, difícilmente en equilibrio por el resto de poderes públicos, y, a la postre, la activa injerencia de estos en los asuntos políticos. De igual modo, este estudio, que pretende alejarse del análisis de esta ilícita maniobra desde un enfoque meramente teórico, examina cómo el lawfare ha sido desarrollado en territorio español, particularmente contra la formación política Podemos, que dice ser víctima de él, y bajo qué ideas fuerzas representa esta fuerza política a este fenómeno en su discurso político. Este grupo, el morado, ha sufrido, desde su irrupción en el tablero político español en 2014, un acoso judicial inédito en la todavía lozana vida de la democracia en España, con el objetivo de ser debilitado, perjudicado e, incluso, destruido políticamente ante el serio riesgo que supone para los intereses del establishment nacional. Esta ofensiva judicial gradual ha provocado que su relación con la justicia, que era un pilar sustantivo para conseguir las demandas políticas, democráticas y sociales que reclamaba esta agrupación, acabe siendo absolutamente confrontacional hoy día por la misma acción implementada por la institución judicial y los jueces contra el grupo izquierdista. Por consiguiente, este estudio repasa cronológicamente, a través del análisis del discurso de Podemos, la evolución histórica que ha presentado su relación con la justicia, la Justicia y los togados e indaga en los acontecimientos que han podido socavarla.

This paper studies lawfare, a worrying phenomenon that has been developing over the last two decades to the detriment of Western democratic systems. This emerging strategy has instrumentalized law and justice and has placed them at the service of a network in which political, economic and media powers combine, illegitimately using the judiciary as a weapon. Its objective is the same as that of the former military coups d'état: to destroy the political adversary. This research, therefore, intends to examine, given its current relevance, lawfare as an integral and multi-causal phenomenon, analyzing briefly how it operates, what historical path it has followed, what devices it involves, what dangers it entails and, especially, what are the reasons that have caused the judiciary, judges and the judicial media to be part of it, The reasons why the judiciary, the judges and the judicial media are an indispensable part of this war from and in the courts, among them, the omnipotent power that judges hold today, which is difficult to balance with the rest of the public powers, and, ultimately, their active interference in political affairs. Similarly, this study, which aims to move away from the analysis of this illicit maneuver from a merely theoretical approach, examines how lawfare has been developed in Spain, particularly against the political formation Podemos, which claims to be a victim of it, and under what ideas-forces this political force represents this phenomenon in its political discourse. This group, the purple one, has suffered, since its irruption in the Spanish political chessboard in 2014, an unprecedented judicial harassment in the still lush life of democracy in Spain, with the aim of being weakened, damaged and, even, politically destroyed in view of the serious risk it poses to the interests of the national establishment. This gradual judicial offensive has meant that its relationship with justice, which was a substantive pillar to achieve the political, democratic and social demands that this group claimed, ends up being absolutely confrontational today because of the same action implemented by the judicial institution and the judges against the leftist group. Therefore, this study reviews chronologically, through the analysis of Podemos' discourse, the historical evolution of its relationship with justice, Justice and the judiciary and investigates the events that may have undermined it.
