Controversia en torno a la indexación de las prestaciones familiares según el país de residencia del causante. Sobre su compatibilidad con el Derecho de la UE

Abstract

Nos referimos en este artículo al debate habido en el seno de las instituciones comunitarias en torno a un eventual mecanismo nacional de indexación de las prestaciones familiares en función del país de residencia del sujeto causante de las mismas. Presentaremos dos momentos claves en esta discusión: 1) La exigencia de esta medida por parte del Reino Unido que acabó con su aceptación por parte del Consejo Europeo en el marco de las negociaciones para evitar el Brexit. 2) La adopción de dicho mecanismo por parte de Austria y la posterior revocación por parte del TJUE a instancias de la Comisión Europea. Criticaremos la posición ambivalente de las instituciones europeas al valorar la adecuación de esta medida al Derecho originario de la UE y nos referiremos de forma más detallada, por su mayor interés jurídico, al pronunciamiento del TJUE emitido en su reciente sentencia de 16 de junio de 2022, asunto C-328/20.

We refer in this article to the debate that took place in the community institutions around a possible national mechanism for indexing family benefits based on the country of residence of the subject causing them. We will present two key moments in this matter: 1) The requirement of this measure by the United Kingdom that ended with the acceptance by the European Council in the framework of the negotiations to avoid Brexit. 2) The adoption of said mechanism by Austria and the subsequent revocation by the CJEU at the request of the European Commission. We will criticize the ambivalent position of the European institutions when assessing the adequacy of this measure to the original law of the EU and we will refer in more detail, due to its greater legal interest, to the pronouncement of the CJEU issued in its recent judgment of June 16, 2022, Case C-328/20.
