Inteligencia artificial y derecho del trabajo

Abstract

A lo largo del presente trabajo se analizan los retos que, para el Derecho del Trabajo del siglo XXI, dentro de pocos años, supondrá la plena automatización de los procesos productivos que se conseguirá como resultado de aplicar la inteligencia artificial al sector empresarial. A su vez, se plantean las distintas alternativas posibles que, en la práctica, podrían ayudar a evitar la drástica disminución de las plantillas que la robotización provocará, así como, a garantizar el mantenimiento de las pensiones por incapacidad y jubilación llegado el momento en el que, nuestro modelo de Seguridad Social, estructurado sobre un sistema de reparto, sea insuficiente para hacer frente a las necesidades sociales que actualmente cubre.

This paper analyzes the challenges that the full automation of the productive processes that will be achieved as a result of the application of artificial intelligence to the business sector will mean for the Labor Law of the XXI century in a few years time. At the same time, the different possible alternatives that, in practice, could help to avoid the drastic reduction in the workforce that robotization will cause, as well as to guarantee the maintenance of disability and retirement pensions when our Social Security model, structured on a pay-as-you-go system, is insufficient to meet the social needs that it currently covers, are discussed.
