Inteligencia artificial y oportunidad de creación de una personalidad electrónica

Abstract

En el actual contexto de avance imparable de la ciencia, la Inteligencia Artificial (IA) viene experimentando una evolución exponencial. A través del presente estudio, analizaremos las cuestiones jurídicas que suscita la eventual creación de una personalidad electrónica para el caso de los robots autónomos más avanzados (cuarta generación robótica). En efecto, las especiales características de estos sistemas –y su dificultad para enmarcarlos en alguna de las categorías jurídicas existentes– demandan un tratamiento específico por parte del Derecho que permita hacer frente a los desafíos de esta clase de tecnología en el futuro. Igualmente, abordaremos los diferentes posicionamientos doctrinales en torno a esta eventualidad para concluir aportando nuestra propia postura al respecto

In the current context of unstoppable advance of science, the Artificial Intelligence (AI) has experienced an exponential evolution. Through this study, we analize the legal issues raised by the eventual creation of an electronic personality in the case of the most advanced autonomous robots (fourth generation robotics). Indeed, the special characteristics of these systems - and the difficulty for framing them in any of the already existing legal categories - demand a specific treatment by the Law that allows us to face the challenges of this kind of technology in the future. Likewise, we address the different doctrinal positions around this eventuality to conclude by contributing our own position in this regard
