This is a legal analysis to detect all relevant elements that have led to the construction of the European trade market for CO2 emission quotas. The first elements are the international obligations under the Kyoto Protocol. This is one of the measures plemented by the EU to fight climate change. A lot of difficulties have been generated but also successes. The elements that have influenced the rule of law are also analyzed as part of the general understanding of why this market. In this sense, it is taken into account the varied interests of States, in its economic outlook, but also political, social, etc., under the principle of subsidiarity. Particularly their national allocation plans. The legal interests of some actors, especially corporations are also analyzed, taking into account in particular the judgments of the Court of Justice of the EU in the field.
