dc.description.abstract | El estudio de la atención a la infancia delincuente y de todas las instituciones
encargadas de su tutela y educación es un asunto poco estudiado en Andalucía
y en concreto en Sevilla. Hasta la implantación de los Tribunales para niños en
España, el tratamiento de menores delincuentes tomaba el camino del hospicio o el
de la cárcel de adultos. Existían escasos centros donde además de acogerlos se les
diera educación. Hasta la época de entre siglos no hay una verdadera preocupación
por el asunto, tanto en América como en Europa.
En España, la protección de menores como empresa pública, organizada y regulada
por el Estado, aparece a principios del siglo XX. Se origina en el marco de un
movimiento de reforma social a partir de 1900, impulsado decididamente desde el
Gobierno por la vía de la legislación social. Todo ello transformaría el Estado liberal-
burgués en un Estado social de Derecho. Hubo una creciente concienciación por
el tema que se reflejó en los temas de congresos, en publicaciones de libros y artículos.
La preocupación se concretó en la Ley de Tribunales Tutelares de menores de
1918, con una jurisdicción especial que impedía su internamiento en prisiones. Para
su funcionamiento, eran necesarias las instituciones auxiliares: las casas de observación
y las casas tutelares o reformatorios. El retraso en su expansión se debe a que
no existía presupuesto para crear todas las infraestructuras en cada provincia.
En Sevilla hubo un movimiento intenso a través de la prensa para que se creara,
en consonancia con lo que ocurría a nivel nacional. Y a pesar del interés político,
tanto de instituciones judiciales, educativas o municipales no se implantó hasta 1930.

dc.description.abstract | The study of delinquent child care and all institutions responsible for
their education and care is a subject barely analyzed in Andalusia and specifically
Seville. Until the introduction of the courts for children in Spain, the treatment of
child offenders took the path of the hospice or adult prison. There were very few
centers where they could live and be educated. Until the time between the two last
centuries there was no real concern about the issue.
In Spain, the child protection as a public issue, organized and regulated by the state,
appears in the early 20th Century. It arises in the context of a social reform movement
from 1900, driven strongly from the Government by way of social legislation. This
would transform the bourgeois-liberal state in a social state of law. There was a growing
awareness on the issue being reflected in conferences, publications of books and
articles. The concern resulted in the Courts Act of 1918 for Juvenile courts with special
jurisdiction which prevented their imprisonment. Auxiliary institutions were necessary:
the houses of observation and the guardianship or reformatories. The delay in the
expansion was due to lack of budget to create the entire infrastructure in each province.
In Seville there was a strong movement for its establishment through the press in
line with what was happening nationwide. And despite of the political interest of
judicial, educational and municipal institutions, they were not implemented until
