La declaración de Bogotá y la articulación normativa de los deberes del ser humano

Abstract

La Declaración Americana de Derechos y Deberes del Hombre, de 1948, es particularmente interesante por tres razones: la primera por haber sido el primer instrumento internacional en abordar los derechos humanos, en segundo lugar, por haberlo hecho de forma holística, teniendo en cuenta los derechos civiles y políticos y los derechos económicos, sociales y culturales y, en tercer lugar, por abordar los deberes del ser humano.Se hacía necesario analizar el valor jurídico de esta Declaración, no por su formato formal sino por sus consecuencias a la luz del tiempo presente. Igualmente se hacía necesario conocer cómo los Estados y la jurisprudencia, con sus interpretaciones y actos jurídicos han aplicado la citada Declaración y, por último, perfilar los deberes concretos e invocables del ser humano, no tanto para determinar las obligaciones de los seres humanos, que también, sino para determinar el marco obligacional de los Estados para asegurar esos deberes. A estos temas se dirige este artículo.

The American Declaration of the Rights and Duties of Man, of 1948, is particularly interesting for three reasons: the first for having been the first international instrument to address human rights, secondly for having done so holistically, taking into account civil and political rights and economic, social and cultural rights and, thirdly, to establish the duties of the human being.It was necessary to analyse the legal value of this Declaration, not because of its formal format but because of its consequences to the light of present times. It was also necessary to know how States and jurisprudence, with their interpretations and legal acts, have applied the aforementioned Declaration and, finally, outline the concrete and invokable duties of the human being, not so much to determine the obligations of human beings, that also, but to determine the obligational framework of the States to ensure these duties. This article is address to these questions.
