El contador-partidor dativo: algunas claves sobre su escaso arraigo práctico y sobre su regulación por la Ley de Jurisdicción Voluntaria.

Abstract

El escueto régimen legal sobre el contador-partidor dativo dibuja una institución algo ambigua, y la escasa jurisprudencia recaída sobre ella poco lo ha podido completan lo que ha supuesto en los años de vigencia de la norma, un obstáculo para su utilización más frecuente. Tomando en cuenta las distintas soluciones apuntadas por la doctrina, y la referencia del régimen del contador-partidor testamentario se proponen aquí las que se estiman más coherentes, adecuadas y funcionales.

The succinct legal regime mi the «contador-partidor dativo» (a kind of partitioner named by the legal clerk or notary)draws a somewhat ambiguous institution, and the scarce jurisprudence existing with regards to this figure has not been able to complete it, all of which has resulted an obstacle to its wider use in the years pursuant with the legal act that recognises the figure. Taking into account the various solutions targeted by the doctrine, and the reference to the testamentary «contador-partidor» (a kind of partitioner named by the testator) regime, the present paper proposes those solutions which are estimated more coherent, adequate and functional.
