Reflections on the issue of decent housing

Abstract

Article 47 of the Spanish Constitution states: "All Spaniards are entitled to enjoy decent and adequate housing". However, the answer to "what is the meaning of decent housing?" cannot be found anywhere. If we considered the Technical Building Code (CTE), it might be said that a decent and adequate home is the one which accomplishes the CTE aims. Nevertheless, according to popular beliefs, there are other ideas implied within the given concept: home ownership or somewhere to become rooted with. That is to say, a home for one's whole life, a solid and permanent construction with some preferences towards certain materials (such as brick or concrete). Regarding urbanism, other considerations such as location, proximity to transport networks, workplaces, hospitals, schools or CBDs can be found as well. By contrast, if this issue is contemplated from a sustainable perspective, these mental structures and cultural behaviours can be counterproductive. That is because there are certain points that would be desirable, such as pursuing a sustainable urban planning or promoting a greater mobility to find a job among population. Within this context, the aim of this article is not to offer a solution (which should be agreed among the differents social agents) but to encourage a debate about the current social housing model and to reflect about different alternatives. Furthermore, a possible anwer for this debate would be the following: the necessity of distinguishing between a dwelling as a property, as a product to be bought and sold; and the minimum social housing unit seen as a need for society. This minimum housing unit would be incompatible with the property of the residence or land. In addition, the formulation of this housing model could be based on a type of dwelling that would be ephemeral, removable, recyclable, bio-climatic, transportable, and that would be located on a piece of land specially intended for it. Finally, a model of housing whose spirit would respond to the consideration that everybody, rather than owning a dwelling, can trust that they will be supplied with a home that meets their requirements for habitability, location and mobility whenever and wherever they will need it.

Según el artículo 47 de la Constitución: "todos los españoles tienen derecho a una vivienda digna y adecuada". El problema surge porque en ninguna parte se responde a la pregunta "¿qué se entiende por vivienda digna?" Si nos atuviéramos al Código Técnico de la Edificación podríamos decir: vivienda digna es aquella que cumple con las prescripciones del CTE. No obstante, el acervo cultural tiene aparte otras ideas sobre lo que considera como tal: vivienda en propiedad, un lugar donde echar raíces, esto es, un hogar para toda la vida, de construcción sólida y permanente con algunas preferencias materiales (ladrillo, hormigón,...), etc. Asimismo, ya fuera del ámbito de la vivienda en sí quedarían otras cuestiones ya relativas al urbanismo como localización, cercanía a las redes de transportes, a los lugares de trabajo, a los equipamientos, a los centros de interés en las grandes ciudades,... Ahora bien, contempladas desde una perspectiva sostenible estas estructuras mentales consolidadas, estos comportamientos culturales pueden resultar contraproducentes respecto a determinadas consideraciones que deberían ser deseables, como ir en pos de un urbanismo sostenible o promover una mayor movilidad entre la población de cara a buscar trabajo. En este contexto, el objetivo del presente artículo, más que plantear una solución, cuestión que debería surgir de un consenso entre los distintos agentes sociales, lo que busca es alentar el debate al respecto, hacia una reflexión sobre una vivienda social diferente a los modelos actuales. Y en cuanto a este debate se ofrece una posible respuesta consistente en la distinción entre la vivienda como propiedad, como producto susceptible de ser comprado y vendido, y la vivienda mínima social digna como una necesidad que responde a lo exigido por la Constitución cuyo provecho no sería compatible con la propiedad de la residencia, ni del suelo. Además, un modelo de vivienda cuya formulación podría basarse en un tipo de construcción efímera, desmontable, reciclable, bioclimática, transportable, en un terreno especialmente reservado para ello, cuyo espíritu respondería al criterio de que cada persona, más que poseer una vivienda en propiedad, pueda contar en todo momento y en todo lugar con una residencia que satisfaga sus requerimientos de habitabilidad, localización y movilidad atendiendo a las diferencias situaciones personales por las que vaya transcurriendo.
