¿Tienen derecho las madres "subrogantes" al permiso y a la prestación por maternidad?

Abstract

El presente artículo tiene por objeto dar respuesta a los padres o madres que han tenido hijos en el extranjero mediante la técnica de gestación por sustitución, que han inscrito esa filiación en el Registro Civil español, y que han solicitado a los tribunales españoles la licencia y la prestación por "maternidad" a la que tienen derecho los padres y madres por acogimiento y adopción. Para ello analizaremos dos sentencias de los Tribunales Superiores de Asturias y Madrid, con argumentos a favor, frente a lo que declara el Tribunal de Justicia de la Unión Europea: no están obligados los Estados miembros a conferir un permiso retribuido de maternidad a una madre subrogante.

The present article aims to respond to parents or mothers who have had children abroad through the technique of gestation by substitution, which have registered this filiation in the Spanish Civil Register, and who have applied to the Spanish courts the license and delivery "maternity leave" that have the right parents and foster care and adoption. To do this, we´ll discuss two judgments of the superior courts of Asturias and Madrid, with arguments in favour, what declares the Court of Justice of the European Union: the Member States are not obliged to give a paid maternity leave to a surrogate mother.
