La transposición de la Directiva de Servicios y la modificación de la Ley 30/1992: el régimen de la declaración responsable y de la comunicación previa

Abstract

El estudio analiza, principalmente, el régimen jurídico de la comunicación previa y de la declaración responsable. Dos nuevas figuras jurídicas que han alcanzado una notable relevancia en nuestro ordenamiento a partir de la transposición de la Directiva de servicios. Su regulación principal, residenciada en el nuevo artículo 71 bis de la Ley 30/1992, de 26 de noviembre, del Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común es objeto de detallada crítica por el autor desde diversas perspectivas. Nos encontramos ante figuras que guardan una notable similitud con otras de antigua presencia en el ordenamiento español, como es el caso de la declaración jurada. Sin embargo, el autor destaca las notables diferencias y, sobre todo, evidencia que la deficiente actuación del legislador resta a estas dos figuras gran parte de la potencialidad que pretende atribuirles la Directiva de Servicios y, con ello, se introducen elementos de inseguridad jurídica en las relaciones entre los administrados y las Administraciones en el control de la realización de ciertas actividades inicialmente sometidas al régimen de comunicación. También se analizan en estas páginas otros aspectos derivados de la transposición de la Directiva de Servicios operada por las Leyes 17 y 29/2009 tales como la posibilidad que abre a los Consejos Consultivos de asumir nuevas funciones.

This study essentially analyses the law and jurisdiction of both advance notice and responsibility statement. These are two new legal notions that have gained considerable relevance in our system after the implementation of the Services Directive. They are ruled mainly under Article 71 bis of Act 30/1992 of the 26 November on the Legal System of the Public Administrations and the Common Administrative Procedure, which will be discussed extensively by the author from different perspectives. Here we are faced with two notions that have a great resemblance with others that have long been present in the Spanish legal system, as is the case of the sworn statement. The author, however, highlights the remarkable differences between them, and above all, he puts forward the effect that the poor action of lawmakers has had on these two legal concepts, denying part of the potentiality that the Services Directive meant to attribute them. As a result, legal insecurity elements arise in the relationship between the citizens and the Administrations when it comes to controlling certain activities that were initially subject to the communication scheme. Another aspect to consider in these pages about the implementation of the Services Directive, operated by Laws 17 and 29/2009, is the possibility that opens up for Advisory Councils to acquire new capacities, among others.
