La peligrosa criminalización de los discursos extremos a través de las TIC

Abstract

La tendencia del legislador penal español de los últimos tiempos ha sido incrementar e inten-sificar sin límite la legislación penal. Pero más alarmante es aún ante la criminalización de los discursos extremos y el llamado discurso del odio terrorista. Ante el miedo que generan los ataques terroristas, el legislador penal, a veces movido por mandatos internacionales, y otras por reclamos sociales, ha visto justificado adelantar las barreras de intervención penal a momentos muy previos a la efectiva lesión de bienes jurídicos para tratar de inocuizar cualquier posible conducta terrorista y para ello no ha tenido problema en poner en juego la seguridad y garantías de nuestro propio Estado de derecho y poner en jaque derechos como la libertad de expresión.

The tendency of the Spanish criminal legislator in recent times has been to increase and intensify criminal legislation without limit. But even more alarming is the criminalization of extreme speech and the so-called terrorist hate speech. Faced with the fear generated by terrorist attacks, the criminal legislator, sometimes moved by international mandates and others by social demands, has seen it justified to advance the barriers of criminal intervention to moments long before the effective damage to legal rights to try to innocuous any possible terrorist behavior and for this it has had no problem putting the security and gua-rantees of our own rule of law at stake and putting rights such as freedom of expression in check.
