La competencia de la Fiscalía Europea: criterios materiales y territoriales para su determinación

Abstract

La Fiscalía Europea es el órgano que asumirá la investigación de las infracciones que afecten a los intereses financieros de la Unión Europea. Su función será esencial para el proceso pues intervendrá en todas sus fases, resaltando sobre las demás competencias la investigación de los hechos. Sin embargo, es necesario concretar cuáles son las infracciones cuya investigación se le han atribuido y conocer las circunstancias que, en caso de concurrir, pueden alterar la competencia inicialmente determinada. En este sentido, el legislador regula el derecho de avocación y la posibilidad de remitir el asunto a las autoridades nacionales cuando las circunstancias del caso lo exijan.

The European Public Prosecutor’s Office is the body that will assume the investigation of the criminal offences affecting the financial interests of the European Union. This function will be essential for the process because EPPO will be intervene in all procedural phases. The investigation of the facts highlight the other competences conferred by the legislator. However, it is necessary to specify which are the offences whose investigation has been allocated within the EPPO. We need to know the criteria that, in case of concurring, can alter the initial competence and, in this sense, the legislator regulates the right of avocation and transfer of proceeding to the national authorities when the circumstances of the case so require.
