La entrada del nuevo siglo y el uso generalizado de las tecnologías digitales y de la inteligencia artificial permiten que se incorporen nuevas formas de empleo informal en el mercado de trabajo. La digitalización y las plataformas digitales facilitan el contacto de prestadores de servicios y usuarios cuyas relaciones no se encuentran recogidas en la normativa del Derecho del Trabajo y de la Seguridad Social. El trabajo a distancia es una modalidad atípica de prestación de servicios regulada en el art. 13 ET. Este artículo fue modificado en la reforma del año 2012 pero sin que fuera contemplado un régimen de la Seguridad Social en materia de contingencias profesionales y de las prestaciones atendiendo a sus peculiaridades del tiempo y del lugar de trabajo. Es una regulación insuficiente que no cubre los espacios nuevos en materia de protección social de los trabajadores de la denominada economía colaborativa. El problema se agrava cuando los trabajadores se sustituyen por robots y las empresas no contribuyen al sistema de seguridad social configurado en el estado de bienestar. En nuestro trabajo mantenemos la necesidad de contribuir a la adaptación de nuestro sistema de protección social a las nuevas realidades del trabajo de acuerdo con los postulados del trabajo decente y con la promoción de los principios y derechos fundamentales del trabajo de la OIT. The beginning of the new century and the widespread use of digital technologies and artificial intelligence allow the incorporation of new forms of informal employment to the labour market. Digitization and digital platforms facilitate the contact between service providers and users in relationships not included in the Labour Law and Social Security regulations. Remote work is an atypical mode of service provision regulated in art. 13 ET. This article was modified in the reform of 2012 without contemplating a specific Social Security regime in terms of professional contingencies and benefits demanded by its peculiarities regarding time and place of work. It is an insufficient regulation that does not cover the social protection of workers in the so-called collaborative economy. The problem is aggravated when workers are replaced by robots and companies do not contribute to the social security system of the welfare state. In our study we defend the need to adapt our social protection system to the new realities of labour in accordance with the principles of decent work and the promotion of fundamental labour principles and rights sustained by the ILO |
