Abstract | La armonización o aproximación legislativa en las distintas ramas jurídicas de la unión europea,
incluyendo el derecho privado, deviene cada vez más necesaria para garantizar un efectivo
cumplimiento de las libertades ... La armonización o aproximación legislativa en las distintas ramas jurídicas de la unión europea, incluyendo el derecho privado, deviene cada vez más necesaria para garantizar un efectivo cumplimiento de las libertades básicas del mercado común europeo al amparo de los derechos fundamentales ya consolidados en los Estados Miembros. La vías para la unificación del derecho privado europeo tienen en cuenta la aplicación en derecho antidiscriminatorio en el derecho privado como límite de la libertad del tráfico privado, dado su carácter consolidado y vertebrador en todas las políticas comunitarias. Fruto del trabajo, elaborado por grupos de expertos juristas en el proceso de unificación del derecho privado europeo, surge el Proyecto de Marco Común de Referencia apoyado por las instituciones de la UE que, como reglas destinadas a ser aplicadas como normas generales del derecho contractual, en el libro I capítulo II codifica la discriminación por razón de sexo en los contratos. El MCR apuesta, decididamente por la inserción con carácter general de reglas configuradoras del principio de no-discriminación en el seno del derecho privado. Dicha regulación supone una especial protección de la Igualdad de género en derecho privado en comparación con los códigos civiles de todos los Estados miembros. La codificación de la discriminación por razón de sexo en los contratos en el capítulo II no es una mera declaración de buenas intenciones. Estas reglas jurídicas en el futuro podrían aplicarse como derecho contractual europeo opcional entre los países miembros. |
