Entiende la presente sentencia del TS, que, aun no habiendo laguna legal que colmar mediante la analogía, ni la interpretación extensiva, desde una interpretación evolutiva y lógica de las últimas reformas legislativas habidas para la protección del deudor hipotecario, cabe interpretar correctoramente el art. 236 g.6 RH, que en su letra no establece límite alguno en la posible adjudicación del inmueble hipotecado y ejecutado en caso de llegar a la tercera y última subasta ante el notario, de modo que pueda aplicárseles los topes que aquellas otras normas establecen en idéntico caso para cuando la ejecución hipotecaria opera judicialmente. Frente a tal postura, entiende el autor de este comentario que el TS ha entremezclado las dos alternativas, radicalmente opuestas entre sí, que tenía: si, en efecto, no hay laguna legal, pues el art. 236 g.6 RH resuelve expresamente una cuestión conforme a su letra y a su espíritu, no habría, entonces, nada que corregir por vía interpretativa. En cambio, solo cabría hacer tal "corrección" de admitirse que, en efecto, haya una laguna legal: no, por supuesto, contenida en aquel art. 236 g.6 RH, sino en la posterior pléyade de reformas legislativas que -supuestamente- han olvidado reformarla en aras de proteger al deudor hipotecario.
