Personas y seres humanos ¿distinción o identidad?

Abstract

Uno de los primeros límites a la ciencia biomédica es la dignidad de la persona, fundamento de los derechos humanos y razón de ser del Derecho. A pesar de que sobre la persona y su dignidad se ha escrito y debatido mucho, lo cierto es que todavía no existe suficiente consenso como para extender la protección de los derechos a todos los seres humanos. Actualmente asistimos a una transformación del concepto de persona que trae como consecuencia la exclusión de un gran número de seres humanos de la titularidad de sus derechos más fundamentales. En concreto, se trata de la distinción entre seres humanos que no son personas y personas que no son seres humanos. Frente a esto, se propone otro concepto de persona, más abarcante de la realidad humana, que pasa por su consideración ontológica y por la característica de la vulnerabilidad

Human dignity is the first limit to the Biomedical Science, it is the base of Human Rights and the reason of Law. Although it has been written and discussed a lot about the concept of person, yet there is not enough agreement to extend the protection of the rights to all human beings. Now, the concept of person is altered and the distinction between persons who are not human beings and human beings that are not persons, is the main consequence of this transformation. On the other hand, against this transformation another concept of person is presented, which embraces more the human reality, taking into account the ontological consideration of the person and how it is characterized by its vulnerability
