dc.description.abstract | Cuando hablamos de legítima colectiva hacemos referencia
al tipo de legítima que existe en Aragón y en el País Vasco, donde los testadores
pueden dejar toda su herencia a cualquiera de sus descendientes, cual
implica al mismo tiempo dejar sin herencia al resto de herederos, situación
que también ocurre en Navarra, donde directamente los testadores disfrutan
de la libertad de testar.
Por tanto, en la actualidad hay más de cuatro millones de españoles
(navarros, vascos y aragoneses) que pueden dejarle toda su herencia a cualquiera
de sus descendientes, sin que tal posibilidad haya supuesto el fin de
las familias en dichas regiones.
Precisamente por ello, el objetivo del presente artículo es aportar una
serie de argumentos jurídicos que, al menos bajo mi punto de vista, nos
pueden hacer cuestionarnos si tras la Ley 8/2021 se ha implementado una
legítima estricta colectiva en el Derecho común, en los supuestos en los que
el testador tenga un descendiente legitimario con discapacidad.
Y es que, si la literalidad del nuevo 808, párrafo cuarto, parece permitirlo,
y existen ya más de cuatro millones de españoles que pueden dejarle
toda su herencia a un descendiente sin discapacidad, ¿por qué no podrán
entonces los testadores sujetos al Derecho común dejarle toda su herencia
al descendiente legitimario con discapacidad? | es |
dc.description.abstract | When we talk about collective legitimate we refer to the
type of legitimate that exists in Aragon and the País Vasco, where testators
can leave their entire inheritance to any of their descendants, which implies
leaving the rest of the heirs without inheritance, a situation that also occurs
in Navarra, where the testators directly enjoy the freedom to test.
Therefore, there are currently more than four million Spaniards (Navarrese,
Basque and Aragonese) who can leave their entire inheritance to any of their descendants,
without this possibility having meant the end of families in those regions.
Precisely for this reason, the objective of this article is to provide a series of
legal arguments that, at least from my point of view, can make us question whether,
after Law 8/2021, a strict collective law has been implemented in common law
in the cases in which the testator has a legitimate descendant with a disability.
And it is that, if the literalness of the new 808, fourth paragraph, seems
to allow it, why then cannot the testators subject to common law leave their
entire inheritance to the legitimate descendant with a disability, if there are
already more than four million Spaniards who can leave your entire inheritance
