Abstract | El uso del ‘hiyab’, o velo islámico, ha sido objeto de debate en los últimos años en el
contexto de libertad religiosa y de los valores sociales y culturales de los países europeos.

El uso del ‘hiyab’, o velo islámico, ha sido objeto de debate en los últimos años en el contexto de libertad religiosa y de los valores sociales y culturales de los países europeos. Por un lado, las posturas de Oriente respecto al uso del velo islámico son defensoras del derecho de las mujeres a usar el ‘hiyab’ como una muestra expresiva de su libertad religiosa. Además, este derecho de Libertad de Religión está recogido en el Artículo 10 de la Carta de los Derechos Fundamentales de la Unión Europea, y en el Artículo 16 de la Constitución Española, los cuales analizaremos más adelante en el marco teórico. Por otro lado, los países occidentales, pertenecientes a la Unión Europea, argumentan que el uso del velo es incompatible con los valores de la sociedad europea, y cuya presencia puede contribuir a la segregación y discriminación. Además, mantienen su rechazo al ‘hiyab’ debido a que el uso del mismo puede ser visto como un símbolo de opresión sobre las mujeres, y también debido a las preocupaciones de seguridad, ya que en algunos casos puede ser visto como una amenaza al ocultar la identidad de una persona. La realización de este trabajo de fin de grado se centra en la investigación de los aspectos mencionados, añadiendo los términos jurisdiccionales de los Tribunales europeos y españoles respecto a las regulaciones del uso del pañuelo islámico. Esto constituye una situación compleja, ya que los preceptos varían en función de un país u otro. The use of the hijab, or Islamic veil, has been the subject of debate in recent years in the context of religious freedom and social and cultural values in European countries. On the one hand, Eastern positions regarding the use of the Islamic headscarf defend the right of women to wear the hijab as an expressive sign of their religious freedom. Moreover, this right to Freedom of Religion is enshrined in Article 10 of the Charter of Fundamental Rights of the European Union, and in Article 16 of the Spanish Constitution, which we will analyze later in the theoretical framework. On the other hand, Western countries, belonging to the European Union, argue that the use of the veil is incompatible with the values of European society, and whose presence can contribute to segregation and discrimination. In addition, they maintain their rejection of the hijab because wearing it can be seen as a symbol of oppression of women, and also because of security concerns, as in some cases it can be seen as a threat by concealing a person's identity. The realization of this final degree work is focused on the investigation of the mentioned aspects, adding the jurisdictional terms of the European and Spanish Courts regarding the regulations of the use of the Islamic headscarf. This is a complex situation, since the precepts vary from one country to another. |
