El convenio colectivo es un instrumento de autotutela cuya finalidad es canalizar el conflicto social, mediante el fomento de un diálogo continuado entre trabajadores y empresarios en condiciones de igualdad. A pesar de que tanto el derecho a la negociación colectiva como la fuerza vinculante del convenio colectivo han sido consagrados a nivel constitucional, su desenvolvimiento, en la práctica, depende en gran medida del marco legal ordinario vigente. La reforma laboral de 2012 instauró modificaciones significativas en el modelo de negociación colectiva de nuestro país. Entre ellas, cabe destacar la posibilidad de modificar unilateralmente las disposiciones contenidas en un convenio colectivo extraestatutario, el “descuelgue” del convenio co-lectivo estatutario y la prioridad aplicativa del convenio de empresa sobre el de sector. Este estudio tiene por finalidad analizar el impacto que estas modificaciones legislativas han tenido en la práctica laboral y valorar si la configuración actual del marco legal que regula la autonomía colectiva permite al convenio colectivo, como fuente del Derecho del trabajo, salvaguardar los valores constitucionales que le han sido encomendados. Although both the right to collective labour bargaining and the enforceability of collective agreements are enshrined in the Spanish constitution, the way these principles operate in practice depends to a great extent on the current ordinary legal framework. The 2012 labour reform brought about significant changes in the Spanish collective bargaining system. It recognised the unilateral faculty of the employer to modify collective agreements of limited scope, the possibility to set aside certain terms of universally applicable collective agreements and the unavoidable preeminence of company collective agreements over sectoral collective agreements. This study not only does purport to analyse the impact of the aforementioned legal reform but also attempts to elucidate whether the current statutory framework does allow collective agreements to safeguard the constitutional values these legal institutions have been entrusted with. |
