La respuesta del sistema prestacional frente al reto COVID-19

Abstract

Desde que en enero de 2020 se identificara un nuevo tipo de coronavirus denominado SARS-CoV-2, una serie de acontecimientos relacionados con la salud pública han marcado profundamente los principios de la realidad sanitaria, social, económica y jurídica a nivel mundial. Las medidas adoptadas en nuestro país para paliar los efectos de la pandemia han ocasionado un elevado coste económico y social. Estas medidas se han articulado jurídicamente en torno a la declaración del estado de alarma y a la publicación de una serie de Reales Decretos-leyes dirigidos a minimizar las consecuencias socioeconómicas de la pandemia. En materia de Seguridad Social, se ha utilizado la adaptación reglamentaria prevista en el artículo 42 del TRLGSS para acompasar el sistema de protección a una realidad marcada por el nuevo agente infeccioso. La prestación de incapacidad temporal se utiliza como instrumento de salud pública para hacer frente a estas nuevas situaciones, modificando la contingencia según el devenir temporal y la adaptación a las necesidades de determinados colectivos, sobre todo sanitarios y socio-sanitarios, por su alto nivel de incidencia. Mediante este estudio se sistematiza la normativa publicada hasta la fecha, ahondando en el momento temporal y la situación de necesidad protegible.

Since a new type of coronavirus called SARS-CoV-2 was identified in January 2020, a number of public health-related events have profoundly marked the principles of global health, social, economic and legal reality. The measures taken in our country to alleviate the effects of the pandemic have led to a high economic and social cost. These measures have been legally articulated around the declaration of the state of alarm and the publication of a series of Royal Decrees-Laws aimed at minimizing the socio-economic consequences of the pandemic. In the area of Social Security, the regulatory adaptation provided for in Article 42 of the TRLGSS has been used to accompany the system of protection to a reality marked by the new infectious agent. The provision of disease is used as a public health tool to deal with these new situations, modifying the contingency according to the temporary becoming and adaptation to the needs of certain groups, especially health workers, for their high level of incidence. This study systematizes the regulations published to date, delving into the time and the situation of protectable need.
