Convenio de Seguridad Social entre España y República Dominicana

Abstract

El autor analiza el Convenio bilateral en materia de Seguridad Social entre España y la República Dominicana. Se subrayan las razones que motivaron la negociación y la ratificación, incidiéndose en los reparos manifestados por la colonia española en la República Dominicana. Se examina la legislación dominicana y se pasa revista al texto del Convenio, haciéndose hincapié en las disposiciones sobre trabajadores desplazados y sobre pensiones, así como en la dificultad de coordinar regímenes de reparto con regímenes de capitalización individual. Por último, se efectúan ciertas reflexiones sobre las peculiaridades del Convenio y su posible futuro.

The author analyzes the bilateral Agreement on Social Security between Spain and the Dominican Republic. The reasons that motivated the negotiation and ratification are highlighted, focusing on the objections expressed by the Spanish colony in the Dominican Republic. Dominican legislation is analyzed, moreover the text of the Agreement is reviewed, with emphasis on the provisions on posted workers and on pensions, as well as on the difficulty of coordinating pay-as-you-go schemes with individual financed schemes.. Finally, certain reflections are made on the peculiarities of the Agreement and its possible next future.
