Razonamiento jurídico y método científico: apuntes para una taxonomía de los paradigmas en juego

Abstract

La ponencia investiga las posibles medidas de entender la relación entre, por un lado, la esfera del estudio del derecho y del razonamiento jurídico, y, por otro lado, la del estudio y del método científico. Al respecto, se propone una taxonomía teórica de los paradigmas en juego, indicando algunas de sus manifestaciones históricas. Se concluye que se puede hablar de “ciencia jurídica” cuando se presenten dos elementos característicos - la actitud objetivista y la apelación a una racionalidad pura y geométrica - y se argumenta que no es deseable renunciar enteramente a tal dimensión del discurso jurídico, aunque con algunas indispensables precauciones.

The paper investigates the possible ways to understand the relation between, on one side, the area of legal study and legal reasoning and, on the other, the area of scientific study and method. At this regard, I propose a theoretical taxonomy of the paradigms at stake, indicating some of its historical manifestations. I conclude that we can speak of “legal science” when two characteristic elements occur - the objectivist attitude and the appeal to a pure and geometric rationality - and I argue that it is undesirable to entirely abandon such dimension of the legal discourse, although with some indispensable precautions
