Todo hace indicar que el cercano proyecto de ley de reforma
legislativa para adaptar el artículo 12 de la Convención a nuestro Ordenamiento
jurídico, en cuanto al ejercicio de la personalidad jurídica de las personas con
discapacidad en igualdad de condiciones con las demás, tendrá como eje central,
contra la voluntad de gran parte de la sociedad, a la institución de la curatela.
Particularmente entendemos que la curatela es la figura idónea para adaptar el
referido artículo de la Convención a nuestro Ordenamiento por varios motivos,
como la gran similitud de la curatela con el administrador de apoyo italiano (que es la figura que fijan como modelo a seguir para adaptar la Convención
los sectores contrarios al actual sistema de incapacitación); o porque la propia
Convención reconoce la figura de la tutela en diversos Estados Parte sin obligarles
a eliminarla; o por el hecho de que la curatela se pueda aplicar tanto en
el ámbito personal como en el patrimonial de la persona que pueda necesitarla;
o por último, la reciente jurisprudencia al respecto de nuestro Tribunal Supremo.; Everything indicates that the upcoming legislative reform bill to
align article 12 of the Convention with our legal system, regarding the exercise
of legal personality of persons with disabilities on an equal footing with others,
will focus on instituting guardianship — against the will of a large portion of
the society. For several reasons, we believe that guardianship is especially the
appropriate legal concept for carrying on the alignment of the above mentioned
article of the convention with our legal system: because of the great similarity
of conservatorship with the support trustee in the italian legal system (the legal
concept which has been set as a model for adapting the convention to the sectors
disagreeing with the current system of disability); because the Convention
recognize the institution of guardianship in many states party without compelling
them to eliminate it; because guardianship may apply both in the personal
scope and in matters relating to property rights of the person who may require
it; finally, because of the recent case law regarding our Supreme Court.

Digital-analog quantum computing is a computational paradigm which employs an analog Hamiltonian resource together with single-qubit gates to reach universality. Here, we design a new scheme which employs an arbitrary two-body source Hamiltonian, extending the experimental applicability of this computational paradigm to most quantum platforms. We show that the simulation of an arbitrary two-body target Hamiltonian of n qubits requires O(n2) analog blocks with guaranteed positive times, providing a polynomial advantage compared to the previous scheme. Additionally, we propose a classical strategy which combines a Bayesian optimization with a gradient descent method, improving the performance by ∼55% for small systems measured in the Frobenius norm.

Recientemente el Gobierno español aprobó la Ley Orgánica
1/2015, de 30 de marzo, de reforma del Código Penal, entre cuyas novedades
se encuentra la sustitución del término procedimiento de incapacitación por el
de procedimiento de modificación de la capacidad, y el término incapacitado
por el de persona con discapacidad necesitada de especial protección. En cuanto
a esta segunda definición me planteo si no habrá sido un error por parte del
legislador el haber incluido en el nuevo término el concepto de persona con
discapacidad. Debido a ello hoy pueden surgir en nuestra sociedad las siguientes cuestiones: ¿Qué sucederá entonces con aquellas personas que con anterioridad
a la entrada en vigor de la ley estuviesen incapacitadas judicialmente pero no
ostentasen la condición de persona con discapacidad? ¿Necesitará en el futuro
una persona para acudir al procedimiento de modificación de la capacidad haber
obtenido previamente la resolución administrativa de persona con discapacidad?
Y lo que es más importante aún, ¿a favor de qué incapacitados judicialmente se
podrá constituir ahora la sustitución fideicomisaria sobre el tercio de legítima
estricta que permite la Ley 41/2003, de 18 de noviembre?.; Recently the Spanish Government approved the Organic Law
1/2015, of March 30th, reforming the Penal Code, being one of its innovations
the replacement of the term disability procedure by the term procedure for
capacity modification, and the term incapable by disabled person in need of
special protection. Regarding this second definition I ask myself if it wasn’t a
mistake by the legislator having included in the new term the concept of person
with disability. Because of this today may appear in our society the following
questions: what will appen with those by which, before the application of this
new law, were judicially disabled and didn’t hold the condition of person with
disabilities? Will a person need, in the future, to address the procedure for capacity
modification, to have had a previous administrative resolution of person
with disability? It occurs to me that to solve this judicial problem in which the
legislator, once again, got us into, we will have to take the civil way and put
on the same level once and for all, automatically, the ruling on incapacitation
and the administrative resolution that recognizes the condition of person with
disabilities. And what’s more important, in favor of those whom it will be possible
to constitute how judicially disabled with Law 41/2003, of 18 de november?.

Dada la importancia adquirida por la sustitución fideicomisaria en
el Derecho Sucesorio español tras la Ley 41/2003 de Protección Patrimonial de las
Personas con Discapacidad, momento a partir del cual fue elegida por el legislador
español como la institución mediante la cual vulnerar el principio histórico de la
intangibilidad de la legítima estricta, la doctrina española y el Tribunal Supremo
deben poner fin al error en el que se viene incurriendo desde hace tiempo a la hora
de dirigirse al fideicomiso y la sustitución fideicomisaria como si fuesen la misma institución,
ya que en realidad son, y siempre lo han sido, dos figuras jurídicas distintas.; By the establishment of the Law 41/2003 of Patrimonial Protection
of Persons with Disabilities the trusteeship estate became in 2003 one of the most
important concept of Spanish Succession Law. It was chosen by the legislature in
2003 as a legal instrument and this is how, for the first time, the sacred and historic
principle of the intangibility of legislation was violated. So the Spanish doctrine and
the Supreme Court must leave the use as sinonymus the fideicommissum and the
trusteeship estate, because in reality are two differents legals instruments.
