Con motivo del análisis, se explora el marco teórico-criminológico en el que se inserta la figura, concretamente, la tesis sostenida por la crimmigración, que evidencia la creciente interrelación entre el derecho penal y las materias administrativas y de extranjería. Asimismo, se hace una aproximación al nacimiento de la expulsión penal, las cuatro reformas sucedidas en un periodo corto de tiempo y se señalan las posturas doctrinales sobre la configuración vigente del tipo. Todo ello, con el objetivo final de presentar una revisión actualizada sobre su estado, debates no resueltos y alcance de un tipo penal controvertido y frecuentemente discutido.This legal-criminological study analyses the figure of expulsion in Article 89 of the Spanish Criminal Code, applicable to foreigners convicted as a substitute for a sentence of more than one year. On the occasion of the analysis, the theoretical-criminological framework in which the figure is inserted is explored, specifically, the thesis sustained by crimmigration, which shows the growing interrelation between criminal law and administrative and foreigners' matters. Likewise, an approach is made to the birth of criminal expulsion, the four reforms that have taken place in a short period of time and the doctrinal positions on the current configuration of the type are pointed out.
