En cuanto a lo primero, por la posibilidad de estimar que ha concurrido un válido consentimiento tácito, en cuanto producido en contrato oneroso; y, en cuanto a lo segundo, porque si el supuesto no se calificara como servidumbre, sería posible, sin cortapisas legales, que el derecho de paso se hubiera adquirido por usucapión.The right of way that has been exercised for more than half a century, which falls as servient tenement on a path composed of portions belonging to each of the various properties that act as dominant tenements, raise several doubts with respect to its legal classification: namely with what concerns its constitutive title and whether if it is possible its acquisition by adverse possession.
