Temas Laborales, 177 (55-93).0213-0750https://hdl.handle.net/11441/176140El reciente RD 893/2024, de 10 de septiembre, por el que se regula la protección de la seguridad y la salud en el ámbito del servicio del hogar familiar, viene a cubrir la laguna sostenida durante casi treinta años a raíz de su exclusión del ámbito de aplicación de la Ley 31/1995, de 8 de noviembre, de prevención de riesgos laborales. Siendo innegable la necesidad de protección de esta prestación ante factores que no han de infravalorarse, la norma plantea una tutela “en diferido”, quedando aspectos cruciales a la concreción por las pertinentes herramientas informáticas. Exhibe, además, un carácter muy estético, con ciertos olvidos y dificultades exegéticas y alguna solución alejada de la realidad del domicilio y las particularidades de las personas trabajadoras domésticas y de quien aprovecha su prestaciónThe recent Royal Decree 893/2024, of 10 September, which regulates health and safety protection in the field of family home services, fills the gap that has existed for almost thirty years as a result of its exclusion from the scope of application of Law 31/1995, of 8 November, on the prevention of occupational hazards. Although there is an undeniable need to protect this benefit in the face of factors that should not be underestimated, the regulation proposes ‘deferred’ protection, leaving crucial aspects to be specified by the pertinent IT tools.
