Vistos los daños observados y proyectados tanto en nuestra economía como en el medio ambiente, se evidencia la necesidad de acción económica climática. Para realizarla, el Derecho es un elemento clave, que bien puede potenciar, retrasar o eludir; aunque en el plano internacional, la soberanía de los Estados puede constituir un obstáculo a una protección eficaz. Las teorías económicas enfrentadas han sido la del decrecimiento económico, que argumenta acertadamente que en un sistema finito no cabe el crecimiento infinito; y de otro lado, el desarrollo sostenible, partidario de un crecimiento económico compatible con generaciones futuras y el resto del medio. Se concluye que, dada la gravedad de la situación, ambas teorías pueden combinarse si el decrecimiento se motiva de forma personal y el desarrollo sostenible se fomenta en el plano empresarial y público.Anthropogenic climate change brings about our cumulative economic growth: the energy sources historically used in production processes have been the main cause of pollution. In view of the observed and projected damage to both our economy and the environment, the need for economic climate action is evident. To achieve this, law is a key element, which can either enhance, delay or circumvent it, although at the international level, the sovereignty of states can be an obstacle to effective protection. The opposing economic theories have been that of economic degrowth, which rightly argues that in a finite system there is no room for infinite growth; and on the other hand, sustainable development, which favours economic growth that is compatible with future generations and the rest of the environment.
