Con el avance tecnológico y la inteligencia artificial, se ha registrado un aumento en la producción, distribución y consumo de este tipo de contenido. Esto implica la generación de imágenes que exhiben a menores en estado de desnudez, contraviniendo los derechos fundamentales. Se cuestiona que la ampliación de Internet ha agravado esta problemática, resaltando la urgencia de una regulación a nivel europeo para supervisar la pornografía infantil generada por la inteligencia artificial. Ante la ausencia de una legislación específica en España, la Ley Orgánica 3/2028, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales establece medidas de proteger a los menores en línea, apuntando a la necesidad de aplicar medidas preventivas y efectivas sobre los menores en el mundo digital.Child pornography is a manifestation of child sexual exploitation and a social problem that often goes unnoticed. With technological advancement and artificial intelligence, there has been an increase in the production, distribution and consumption of this type of content. This involves the generation of images that show minors in a state of nudity, contravening fundamental rights. It is questioned whether the expansion of the Internet has aggravated this problem, highlighting the urgency of regulation at the European level to supervise child pornography generated by artificial intelligence.
