Abstract | La Ley Concursal ha dispuesto de fórmulas flexibles en interés del concurso y sin perjuicio de la contraparte para permitir la rehabilitación de los contratos de crédito (artículo 68) o de adquisición de bienes con precio ... La Ley Concursal ha dispuesto de fórmulas flexibles en interés del concurso y sin perjuicio de la contraparte para permitir la rehabilitación de los contratos de crédito (artículo 68) o de adquisición de bienes con precio aplazado (artículo 69), así como la enervación de desahucio en arrendamientos urbanos (artículo 70), afectados por incumplimientos del deudor concursado. El estudio de cada una de estas rehabilitaciones se va a detener en el análisis de los respectivos ámbitos de aplicación, requisitos, efectos y las causas de oposición a las mismas. Con especial hincapié en la relación existente entre la rehabilitación de los contratos de crédito y de adquisición de bienes con precio aplazado con la facultad que al administrador concursal se le otorga en el artículo 155.2 LC, cuando se trata de contratos de préstamo, o de crédito, o de adquisición de bienes con precio aplazado garantizados con privilegio especial. |
